Terms of Service

1. Who we are and what these terms cover

These Terms of Service ("Terms") govern your access to and use of crumplz (the "Service"), operated by Pierre-Alain Schwer (recibo verde, Portugal), trading as crumplz ("crumplz", "we", "us"). By creating an account, joining the waitlist, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service is intended for businesses and professionals (advertisers, brands, agencies and media buyers using Meta advertising). It is not directed at consumers acting for personal purposes.

2. The Service

crumplz monitors your connected Meta advertising accounts at regular intervals and sends alerts (via WhatsApp, Slack and/or email) when it detects anomalies such as ROAS drift, CPA spikes or CTR drops. crumplz is a monitoring and alerting tool. It does not manage your ad spend for you, does not guarantee advertising performance, and is not affiliated with, endorsed by, or operated by Meta Platforms, Inc.

3. Accounts and acceptable use

You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your account. You agree not to misuse the Service, attempt to disrupt it, reverse-engineer it, or use it to violate the terms of any third-party platform (including Meta) you connect.

4. Subscriptions, billing and renewal

The Service is offered on a paid subscription basis, billed either monthly or annually, depending on the plan you select.

• Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or annual) for a new period of the same length, at the then-current price, unless you cancel before the renewal date.
• Cancel anytime. You may cancel your subscription at any time. Cancellation stops the next renewal; your plan remains active until the end of the period you have already paid for. There is no long-term lock-in.
• Annual plans. Annual plans are billed once for twelve (12) months and are offered at a discount equivalent to two (2) months free versus paying monthly.
• Price changes. We may change prices for future billing periods. We will give reasonable advance notice, and changes never apply to a period already paid.
• Taxes. Prices are exclusive of any applicable taxes, which are added where required by law.

5. Refunds and right of withdrawal

Because the Service is intended for business customers, statutory consumer cooling-off rights do not generally apply. Outside of any mandatory rights described below, payments are non-refundable, and cancelling stops future renewals rather than refunding the current period.

If, and only if, you qualify as a consumer under applicable law (for example certain EU/EEA consumers), you may have a statutory right to withdraw within fourteen (14) days. Where the Service is supplied digitally and begins immediately at your request, you acknowledge that you may lose that withdrawal right once performance has begun with your prior express consent.

6. Availability and disclaimer

We work to keep the Service available and accurate, but it is provided "as is" and "as available", without warranties of any kind. Monitoring depends on third-party data (including Meta APIs) that may be delayed, incomplete or unavailable. crumplz does not guarantee that every anomaly will be detected, that alerts will always be delivered, or that acting on an alert will improve results.

7. Limitation of liability

To the maximum extent permitted by law, crumplz will not be liable for indirect, incidental or consequential damages, nor for lost profits, lost ad spend, or business losses arising from the use of, or inability to use, the Service. To the extent liability cannot be excluded, it is limited to the amount you paid for the Service in the twelve (12) months preceding the event giving rise to the claim.

8. Termination

You may stop using and cancel the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service unlawfully.

9. Governing law

These Terms are governed by the laws of Portugal, and the competent courts of Portugal will have jurisdiction, without prejudice to any mandatory consumer-protection rules of your country of residence.
